29 CFR  1910.178(l): ): This is applicable to construction employment as referenced by 1926.602(d). The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   The employer failed to protect employees engaged in power industrial truck operations from crushing and struck-by hazards.  This was most recently documented on or about March 24th, 2022, in Gretna, Nebraska 68028.  The forklift operator that was observed operating a forklift had not completed forklift training to include a classroom portion, and written test that meets the requirements of OSHA standard 1910.178(l) powered industrial trucks, operator training.

Employees were retrieving construction material from a mobile platform located near the 2nd level of the residential structure at heights greater than 16 feet.

Employees were observed conducting framing operations at heights greater than 16ft without any form of fall protection.    Llamas  Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1347449, citation number 1, item number 2and was affirmed as a final order on 11-20-2018, with respect to a workplace located at 4218 207th Street, Elkhorn, Nebraska 68022.
