29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Robotic ice stacker; On or about April 6, 2022 and at times prior to the employer exposed noise at levels 58.9% dose (equivalent to a 8  hour TWA of 86.1 dBA) which is approximately 1.17 times the action level of 50% dose (equivalent to a 12 hour TWA of 82.1).  Results are based on 642 minutes sampling period of a 720 minute shift.  Exposure calculations included a zero increment for the 78 minute period not sampled.  The employer did not administer a continuing, effective hearing conservation program.

29 CFR  1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:   a) Robotic ice stacker; On or about April 6, 2022 and at times prior to the employer exposed noise at levels 58.9% dose (equivalent to a 8  hour TWA of 86.1 dBA) which is approximately 1.17 times the action level of 50% dose (equivalent to a 12 hour TWA of 82.1).  Results are based on 642 minutes sampling period of a 720 minute shift.  Exposure calculations included a zero increment for the 78 minute period not sampled. 29 CFR  1910.147(c)(4)(i):Procedures were not developed for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a) Robotic ice stacker; On or about April 4, 2022 and at times prior to the employer exposed employees to struck-by hazards in that employees were allowed to enter the robotic cell to clear jams without first developing procedures to control hazardous stored energy or inadvertent start up of the machine.

29 CFR  1910.147(f)(3)(ii)(D): Each authorized employee did not affix a personal lockout or tagout device to the group lockout device before working on the machine or equipment:   (a) Robotic ice stacker; On or about April 4, 2022 and at times prior to the employer exposed employees to struck-by hazards in that employees were allowed to enter the robotic cell to clear jams without each employee first applying a lockout device to prevent inadvertent start-up.
