OSH ACT pf 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm. a) Resin Warehouse area: On or about April 6, 2022, and at times prior to, employees were exposed to fire, explosion and deflagration hazards while conducting resin pastel transfer and packaging work activities from two Donaldson Equipment, Inc. dust collection systems with the combustible dust located inside the building.

29 CFR 1910.22(a)(1):29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. a) Resin Warehouse: On or about April 6, 2022, and at times prior to, the employer exposed employees to fire and explosion hazardous conditions in that there was combustible dust accumulations on the upper mezzanine resin pastel transfer equipment of above 4 inches and on the floor around the supersacks below the two dust collectors measuring half and inch.
