OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from an elevated platform supported on the forks of a rough terrain forklift:  a) Job Site - Employees were observed working from an elevated platform supported on the forks of a JCB 506B Loadall rough terrain forklift. The platform width was greater than the width of the truck (measured across the load bearing tires, plus 10 inches on either side), on or about April 21, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.   a) Job Site - Employees were observed working from an elevated platform supported on the forks of a JCB 506B Loadall rough terrain forklift 11 feet high above the ground. The platform measured approximately 16 feet long x 3 feet 9 inches wide and had not been designed by a qualified person, on or about April 21, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   a) Job Site - Employees were observed working from an elevated platform supported on the forks of a JCB 506B Loadall rough terrain forklift and the platform was not securely attached to the forklift, exposing the employees to an approximate 11 foot fall hazard to the ground below, on or about April 21, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Job Site - Employee(s) installing sheathing to a steep pitched residential roof were not protected from an approximate 20 foot fall hazard to the ground below, on or about April 21, 2022.  b) Job Site - Employee(s) installing sheathing to a steep pitched residential roof were not protected from an approximate 10 foot fall hazard to the floor below, on or about April 21, 2022.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

The operator had dismounted the cab leaving the forks elevated and no one at the controls exposing the employees to an approximate 11 foot fall hazard to the ground below, on or about April 21, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
