OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from an elevated platform supported on the forks of a rough terrain forklift:   a) Job Site - Employees worked from an elevated platform supported on the forks of a Pettibone, Model 10056 rough terrain forklift. The platform width was greater than the width of the truck (measured across the load bearing tires, plus 10 inches on either side), on or about October 6, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design:   a) Job Site - Employees worked from an elevated platform supported on the forks of a Pettibone, Model 10056 rough terrain forklift approximately 15-feet above ground. The platform measured 17 feet long x 4 feet wide and had not been designed by a qualified person, on or about October 6, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section:  a) Job Site - Employees worked from an elevated platform supported on the forks of a Pettibone, Model 10056 rough terrain forklift which did not have endrails and were exposed to an approximate 15-foot fall hazard to the ground below, on or about October 6, 2022.  Abatement certification required within 10 days after abatement date. 29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) Main Roof - An employee installed a gable end onto the main roof of a residential home was not protected from an approximate 20-foot fall hazard to the ground below, on or about October 7, 2022.  b) Garage Roof - An employee installed trusses onto the garage roof was not protected from an 11 foot - 7 inch fall hazard to the ground below, on or about October 7, 2022.  c) Roof - Employees installed sheathing onto the main roof a residential home and were not protected from fall hazards up to 20 foot - 3 inches to the floor below, on or about October 6, 2022.  d) 1st Floor - Employees conducted framing operations adjacent to an uncovered floor hole and were not protected from an 8 foot - 10 inch fall hazard to the floor below, on or about October 7, 2022.  e) 2nd Floor - Employees conducted framing operations adjacent to unguarded window openings, without top rails above the sill plates and were not protected from fall hazards up to 15 feet - 8 inches to the  ground below, on or about October 6, 2022.   f) 2nd Floor - Employees were exposed to a 10-foot fall hazard while accessing and egressing the second floor which did not have guardrails installed along each open edge, on or about October 7, 2022.  Abatement certification and documentation required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.  C.K. King Builders, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1575909, citation number 1, item number 3, and was affirmed as a final order on May 16, 2022, with respect to a workplace located at 306 Reserve Lane, Mechanicsburg, PA 17050.
