OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. At the worksite located at 5302 Stockyards Expressway, Saint Joseph, Missouri. Employees on the hot side(kill side) were exposed to amputation hazards when operating The Jarvis Model SEC 400 Hog Splitting Saw during production with the anti-tie safety feature malfunctioning.

29 CFR 1910.147(c)(2)(ii):An energy isolating device that was capable of being locked out, did not utilize a lockout device, which rendered the machine or equipment inoperative. At the worksite located at 5302 Stockyards Expressway, Saint Joseph, Missouri. Employees on the hot side(kill side) hog processing line were exposed to amputation and struck by hazards when a energized back up Jarvis Model SEC 400 Hog Splitting Saw was positioned in the same space and was not locked out and not in use per manufacturers instruction.
