29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: a) On or about 5/9/2022 at a roof project located at 23 Hayden Street, Buffalo, New York; employees performing roofing activities from a ladder jack scaffold approximately 18 feet high were not protected from falling by a personal fall arrest system. NO ABATEMENT CERTIFICATION REQUIRED Joe Mann dba Mann Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1446650, citation number 1, item number 2 and was affirmed as a final order on 11/4/2020, with respect to a workplace located at 300 Allegany Road, Darien Center, New York.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 5/9/2022 at a roof project located at 23 Hayden Street, Buffalo, New York; employees were placing shingles on the roof of a two story house. The roof had multiple pitches including an 8 in 12 pitch with an eave height of approximately 20 feet. There was no fall protection in use. NO ABATEMENT CERTIFICATION REQUIRED Joe Mann dba Mann Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1446650, citation number 1, item number 3 and was affirmed as a final order on 11/4/2020, with respect to a workplace located at 300 Allegany Road, Darien Center, New York.
