29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were an employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On 9 May 2022, at least four employees under Julio Cesar Guerrero were working on the roof of an apartment/condominium located just off of South Saint Peters Parkway, near 139 Harvester Court in Saint Peters, Missouri. They were not utilizing guardrail systems, a safety net system, or a personal fall arrest system. The employees were observed on the roof of the building without fall protection, exposing them to falls to the ground below. Julio Cesar Guerrero was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1536821, citation number 1, item number 2 and was affirmed as a final order on 11/16/2021, concerning a workplace located on lot 17 Pike Street, Saint Charles, MO 63301.

On 9 May 2022, at least one employee under Julio Cesar Guerrero was working on the roof of an apartment/condominium located just off of South Saint Peters Parkway, near 139 Harvester Court in Saint Peters, Missouri. They were not utilizing or required to wear eye protection while using a pneumatic nail gun. Julio Cesar Guerrero was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.28(a), which was contained in OSHA inspection number 1536821, citation number 1, item number 1 and was affirmed as a final order on 11/16/2021, concerning a workplace located on lot 17 Pike Street, Saint Charles, MO 63301.
