OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards while erecting an exterior wall on a residential structure: (a) Jobsite at 98 Bayview Drive in Jamestown, RI: On or about May 18, 2022, the employer exposed employees to struck-by and crushed-by hazards while lifting a two by eight framed exterior wall, that measured approximately 13'6" high by 39'10" long and weighed approximately 2790 lbs., with inadequate manpower and equipment.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: (a) Jobsite at 98 Bayview Drive in Jamestown, RI: On or about May 18, 2022, the employer failed to provide training to employees on the struck-by and crushed-by hazards related to raising walls without the use of proper equipment and adequate manpower to safely lift a wall into position.
