29 CFR 1926.102(a)(1):Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  The employer failed to protect an employee from eye injuries associated with pneumatic nail guns and power tools. This was most recently documented on or about May 27, 2022 at a residential construction jobsite located at 5508 N. 208th St., Elkhorn, Nebraska. An employee was operating a pneumatic nail gun while engaged in residential framing activities without the use of eye protection.  Vargas Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.102(a)(1), which was contained in OSHA inspection number 1559450, citation number 1, item number 2 and was affirmed as a final order on January 14, 2022, with respect to a workplace located at 3935 South 208th street, Elkhorn Nebraska.

29 CFR 1926.451(c)(2)(v):Fork-lifts were used to support scaffold platforms where the entire platform was not attached to the fork.  The employer failed to protect an employee exposed to fall hazards when conducting residential construction operations. This was most recently documented on or about May 27, 2022 at a residential construction jobsite located at 508 N. 208th St., Elkhorn, Nebraska. The employer did not ensure that a supported scaffold platform that was being used with a powered industrial truck was secured to the forks.  Vargas Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.451(c)(2)(v), which was contained in OSHA inspection number 1548217, citation number  1, item number 1 and was affirmed as a final order on November 10, 2021, with respect to a workplace located at 2901 209th Ct., Elkhorn Nebraska.

The employer failed to protect an employee from fall hazards when conducting framing operations on a residential structure while working from an elevated mobile scaffolding. This was most recently documented on or about May 27, 2022 at a residential construction jobsite located at 5508 N. 208th St., Elkhorn, Nebraska. The exposed employee was not utilizing any form of fall protection when working from the elevated mobile scaffolding that was not fully guarded at a height greater than 10 feet.  Vargas Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.451(g)(1), which was contained in OSHA inspection number 1548217, citation number 1, item number 2 and was affirmed as a final order on November 10, 2021, with respect to a workplace located at 2901 209th Ct., ELKHORN, NE 68022.

This was most recently documented on or about May 27, 2022 at a residential construction jobsite located at 5508 N. 208th St., Elkhorn, Nebraska. The exposed employee was working on the unfinished roof of the residential structure at heights over 6 feet and not utilizing any form of fall protection.  Vargas Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1559450, citation number 1, item number 4 and was affirmed as a final order on January 14, 2022, with respect to a workplace located at 3935 South 208th street, ELKHORN, NE 68022.
