29 CFR 1926.501(b)(2)(i):  Each employee constructing a leading edge 6 feet (1.8m) or more above a lower level was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems.  Note: If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 must developed and implemented:  On May 27, 2022, employees of LMT Construction LLC were constructing an apartment complex located at 3431 Technology Drive in Lake Saint Louis, Missouri.  The employees were on the of the building constructing the edge of the roof, approximately 27 feet above a lower level.  Employees were not utilizing guardrail systems, a safety net system, or a personal fall arrest system.

29 CFR 1926.602(d):  Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter:  29 CFR 1910.178(l)(l)(ii):  Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (1), except as permitted by paragraph (1)(5):  On May 27, 2022, employees of LMT Construction, LLC were constructing an apartment complex located at 3431 Technology Drive in Lake Saint Louis, Missouri.  A JLG telehandler Model # 10054, Serial # 01600-73897, was used to lift lumber to the elevated floor under construction.  The employer did not ensure that employees were trained before they operated a powered industrial truck.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within four business hours.  On June 1, 2022, the employer failed to provide copies of the injury illness records within the required four business hours after they were requested both verbally and in writing.
