The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated a) 45 Norwood Ave., Allenhurst, NJ: An employee was working in the basket of a 450AJ JLG telescopic articulating boom lift serial number 0300061590 and was not anchored to the lift via tie off point exposing him to potential fall hazards. The employee was installing soffit material and also providing material for other employees working off a ladder scaffold. Condition observed on or about 5/31/2022

29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person. a) 45 Norwood Ave., Allenhurst, NJ: Employees were working on a ladder jack scaffolding while performing soffit installation. The employees were utilizing an improper tie-off point exposing the employees to a fall of approximately 15 feet to the ground below. Conditions observed on or about May 31, 2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
