29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a. Meritage Homes of Colorado, Inc. at 6087-6089 N. Liverpool St Aurora, CO 80019: On June 13, 2022, the controlling employer did not ensure that subcontracted employees were protected from injury, in that subcontracted employees were conducting framing operations at heights over 15 feet on a new residential construction without the use of any means of fall protection. This condition exposes to employees to head injuries and broken bones.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: a. Meritage Homes of Colorado, Inc. at 6087-6089 N. Liverpool St Aurora, CO 80019: On June 13, 2022, the controlling employer did not ensure that subcontracted employees were protected from injury, in that portable ladders used to access the first level a residential home, did not have side rails extending at least 3 feet above the upper landing, and it was not secured. The employer did not protect employees against falls at heights over 15 feet. This condition exposes to employees to head injuries and broken bones.
