The use of any machinery, tool, material, or equipment which is not in compliance with any applicable requirement of this part is prohibited. Such machine, tool, material, or equipment shall either be identified as unsafe by tagging or locking the controls to render them inoperable or shall be physically removed from its place of operation. a) On or about June 15, 2022, the employer did not ensure that during an inspection to determine the cause of a defect on the S300-AL Roll Former Traveling Machine, the machine was identified as unsafe or by locking or tagging out or by the removal of the machine resulting in an amputation.

The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about June 15, 2022, The employer did not ensure that operators of the S300-AL Roll Former Traveling Machine were adequately trained as authorized employees to recognize the need to lock-out the equipment while performing inspection.
