29 CFR 1910.147(d)(6): Prior to starting work on machines or equipment that had been locked out or tagged out, the authorized employee did not verify that isolation and de-energization of the machine or equipment had been accomplished: (a) Mars Wrigley Confectionary US, LLC, 295 Brown Street, Elizabethtown, Pennsylvania - Employees cleaned tanks, including the Dove chocolate batching 20 micron tank. The employees did not verify isolation and de-energization of all energy sources prior to applying locks to the group lock box and commencing work, exposing employees to hazards such as caught-in, struck-by, and engulfment, on or about June 9, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.147(f)(2)(i): When outside servicing personnel were engaged in activities in a facility, the onsite employer and the outside employer did not inform each other of their respective lockout or tagout procedures: (a) Mars Wrigley Confectionary US, LLC, 295 Brown Street, Elizabethtown, Pennsylvania - Employees cleaned tanks, including the Dove chocolate batching 20 micron tank, owned by the onsite/host employer, Mars Wrigley. Mars Wrigley required the use of its energy control procedures. I.K. Stoltzfus Service Corp. did not obtain the energy control procedures for the tanks from the onsite/host employer, on or about June 9, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The tank had electric, pneumatic, and liquid product energy sources. Each employee did not affix a personal lockout/tagout device to the group lock box before entering the tank, exposing employees to hazards such as caught-in, struck-by, and engulfment, on or about June 9, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
