29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- 69 Edgecomb Avenue, Lakewood NJ: A worker was exposed to fall hazards, up to and in excess of 15 feet 4 inches to the ground surface below, when walking and working from the top plates of a residential structure's wall frames without the use of fall protection.  Condition observed on or about 06/29/22.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  a- 69 Edgecomb Avenue, Lakewood NJ: A worker was exposed to fall hazards, in excess of 9 feet to the floor surface below, when working from a portable, fiberglass A-framed ladder containing a visibly damaged leg that was field repaired using screws and a board. Condition observed on or about 06/29/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
