29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Jobsite located on 2600 E Hagert St., Philadelphia, PA 19125 - On or about August 18, 2022, the employer did not develop or maintain a safety and health program to include, but not limited to, identification and control of hazards, training and education, and work safety rules and procedures to enable employees exposed to fall hazards to recognize and avoid unsafe conditions at the workplace.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Jobsite: located at 2600 E Hagert St., Philadelphia, PA 19125 - On or about August 18, 2022, the employer failed to ensure that an employee conducting framing activities on the exterior wall of a residential building through a wall opening, approximately 20 feet above ground level, was protected from fall hazards by the use of a fall protection system.  Encore Builders, Inc was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1581604, citation number 1, item number 3, and was affirmed as a final order on 07-07-2022, with respect to a workplace located at 6 Fdr Drive, Berlin Township, NJ 0809.
