Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards: a) Inside Building 1 - Dust collector area at the BCP Blast Cleaning Products LTD dust collection system: On or about July 4, 2022, and at times prior to, employees were exposed to fire, explosion and deflagration hazards during abrasive blasting and waste drum removal work activities containing combustible dust at the BCP Blast Cleaning Products, LTD dust collection system located inside Building 1. b) Inside Building 1 - Dust collector area: On or about July 4, 2022, and at times prior to, the employer exposed employees to fire, explosion and deflagration hazards during abrasive blasting and waste drum removal work activities at the BCP Blast Cleaning Products, LTD dust collection system, containing combustible dust, and deflagration venting was not provided. c) Inside Building 1 - Dust collector area: On or about July 4, 2022, and at times prior to, the employer exposed employees to fire, explosion and deflagration hazards during abrasive blasting and waste drum removal work activities at the BCP Blast Cleaning Products, LTD dust collection system, containing combustible dust, and recycled exhaust air inside the building.

29 CFR 1910.252(a)(2)(xiii):The employer did not recognize its responsibility for the safe usage of cutting or welding equipment on its property, in accordance with 29 CFR 1910.252 (a)(2)(xiii)(A) through 29 CFR 1910.252(a)(2)(xiii)(D): a) Bush Hog Building 1 - Dust Collector Area: On or about July 4, 2022, and at times prior to, the employer exposed West Alabama Mechanical, Inc. employees to combustible dust fire, explosion and deflagration hazards, in that the employer failed to recognize its responsibility for the safe usage of oxygen and acetylene cutting torch activities conducted on the dust collector inside of Building 1.
