29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: (a) On or about July 13, 2022, an annual/periodic inspection of the energy control procedures had not been conducted for, but not limited to the the Schelling cut-to-size saw to ensure that procedures and requirements of the standard are being followed and that employees who implement energy control procedures understand their application.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (a) On or about July 13, 2022, an employee was working under the Schelling cut-to-size saw, trouble shooting an air leak at the rest position of the saw carriage. The saw was not deenergized, locked out, and the saw carriage not blocked to prevent the saw from returning to the home position. This exposed the employee(s) to a struck-by and crushing hazard. The employer failed to implement energy control application steps as the machines were not isolated from all energy sources [per the 1910.147(d)(3) requirements]. As a result, the remaining applicable energy control elements, involving LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine hazards.

29 CFR 1910.147(c)(7)(i):The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees: (a) On or about July 13, 2022, employees performing maintenance and servicing on the Schelling cut-to-size saw, were not adequately trained to recognize the types of energy sources associated with the equipment, and how to implement energy isolating methods to prevent the inadvertent release or start-up of equipment being worked on.
