OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees due to collapse of storage rack system and crushing hazards: (a) Storage Warehouse, A Rack: On August 18, 2022 and times prior, employees use forklifts to load and unload material on the storage rack system. Employees are exposed to storage rack system collapse/failure due to vertical support damage that affect the stability of the storage rack system. The storage rack system vertical supports had deflections from center at approximately 3.5 inches per 10 feet in height. (b) Storage Warehouse, C Rack: On August 18, 2022 and times prior, employees use forklifts to load and unload material on the storage rack system. Employees are exposed to storage rack system collapse/failure due to vertical support damage that affect the stability of the storage rack system. The storage rack system vertical supports had deflections from center ranging from 1 to 3 inches per 10 feet in height. (c) Storage Warehouse, F Rack: On August 18, 2022 and times prior, employees use forklifts to load and unload material on the storage rack system. Employees are exposed to storage rack system collapse/failure due to vertical support damage that affect the stability of the storage rack system. The storage rack system vertical supports had deflections from center at approximately 5 inches per 10 feet in height.
