29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer:  The employer was failing to protect employees from respiratory illnesses. This was most recently documented on or about October 12, 2022 at the Stone Concepts facility located at 10802 Sapp Brothers Drive, Omaha, Nebraska. Employees engaged in dry cutting activities were exposed to respiratory hazards, including but not limited to respirable silica. Tight-fitting N-95 respirators were required for dry cutting activities by the employer, but the employer did not establish a written respiratory protection program.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  The employer was failing to protect employees from respiratory illnesses. This was most recently documented on or about October 12, 2022 at the Stone Concepts facility located at 10802 Sapp Brothers Drive, Omaha, Nebraska. Employees engaged in dry cutting activities were exposed to respiratory hazards, including but not limited to respirable silica. Installers may use half facepiece respirators voluntarily, but the employer did not establish and implement necessary elements of a respiratory protection program.

Employees engaged in dry cutting activities were exposed to respiratory hazards, including but not limited to respirable silica.
