29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) 40 Foundry Boulevard, Mount Holly NJ: The employer did not ensure that each employee who utilized a Pettibone All-Terrain lift  at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 09/03/22. On or about 09/03/22 the employer and a worker were working from a unsecured sheet of OSB that was elevated by the forks of an unattended All-Terrain lift thus exposing them to fall hazards.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set.   a) 40 Foundry Boulevard, Mount Holly NJ: On or about 09/03/22, a Pettibone All-Terrain lift, that was being used to support a job made scaffold containing materials and framing equipment, was left unattended with the load engaging means raised and extended, exposing workers to the hazard of being struck by the vehicle or its supported load.

Condition observed on or about 09/03/22.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a- 40 Foundry Boulevard, Mount Holly NJ: On or about 09/03/22 a worker and the company worksite Foreman were exposed to fall hazards, in excess of  30 feet to the ground surface below, when working/walking from a single piece of OSB (reinforced with 2 x 4s) while it rested, unsecured on the elevated forks of an all terrain fork truck. This piece of equipment was not specifically designed by the manufacturer to support a scaffold platform.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The worker and worksite Foreman were not utilizing any fall protection at the time of the exposure. 29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   a- 40 Foundry Boulevard, Mount Holly NJ: On or about 09/03/22 a worker and the company worksite Foreman were exposed to fall hazards, in excess of  30 feet to the ground surface below, when an all terrain fork truck was used to support a single piece of OSB (reinforced with 2 x 4s) that they were working from.   This single piece of OSB (reinforced with 2 x 4s) was was not attached to the forks of this fork truck.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
