29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: a) 1109 Peachtree Run, Magnolia, DE 19962 - Front Yard: On or about September 7, 2022, employees observed working in proximity to energized power lines and not protected from electric shock while using an aluminum ladder to access/egress into a trench/excavation placed over energized power lines. The only means of egress (aluminum ladder) for employees entering and exiting the trench/excavation was laying over a live power line. The power lines were energized with up to 240 volts using 3-phase and up to 200 amps of electrical power. The weather conditions consisted of rain on and off that day and very wet conditions expanded the shock/electrocution hazard over a wider area.

29 CFR 1926.651(a): All surface encumbrances that were located so as to create a hazard to employees were not removed or supported, as necessary, to safeguard employees: a) 1109 Peachtree Run along the roadway, Magnolia, DE 19962 - Front Yard: On or about September 7, 2022, employees observed working near an undermined an adjacent utility pole, holding both communication and power lines as they dug a trench/excavation directly adjacent to the pole not supporting the pole. Employees were exposed to shock/electrocution hazards associated with the lack of support by the power lines as well as caught in hazards due to the potential collapse of the power pole.

29 CFR 1926.651(b)(4): While the excavation was opened, underground installations were not protected, supported or removed as necessary to safeguard employees: a) 1109 Peachtree Run, Magnolia, DE 19962 - Front yard: On or about September 7, 2022, employees were required to work in the trench/excavation with unprotected and ungrounded buried electrical lines that were exposed once the area was excavated. The power lines were energized and ran from one side of the trench/excavation to the other side of the trench/excavation exposing employees to shock/electrocution hazards.
