29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about September 8, 2022, at the above addressed jobsite, employees using pneumatic nail guns were not wearing safety glasses, thereby exposing employees to hazards associated with eye injuries.  LM Construction 1 Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1595493, citation number 1, item number 1, and was affirmed as a final order on July 22, 2022, with respect to a workplace located at 322 W. 22ns Street, Hinsdale, IL 60521.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. On or about September 9, 2022, at the above addressed jobsite, an employee performing residential carpentry operations, nine (9) feet one (1) inch above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  The LM Construction 1 Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13)), which was contained in OSHA inspection number 1595493, citation number 2, item number 1, and was affirmed as a final order on July 22, 2022, with respect to a workplace located at 322 W. 22nd Street, Hinsdale, IL 60521.  The LM Construction 1 Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1543396, citation number 1 , item number 1,  and was affirmed as a final order on December 21, 2021, with respect to a workplace located at 872 (Lot 41) W. Woodlawn Rd. New Lenox, IL 60451.
