29 CFR 1917.27(a)(1)  Employees other than those determined by the employer to be competent through training or experience were permitted to operate a crane, winch, or other power operated cargo handling apparatus, or power operated vehicle, or to give signals to the operator of hoisting apparatus.  a)  Water's edge: On or about August 5, 2022, the employer allowed non-trained and non-certified employee(s) to operate a Caterpillar 908M with fork attachments, exposing employees to struck-by hazards.
