29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a. The employer does not protect each employee from falling hazards from elevated heights, by using fall protection systems.  The most recently occurred on or about August 25, 2022, on the job site located at 621 Peck Lane Lot 72, New Albany, OH 43054. The employer fails to ensure effective protections against falls as required by the standard, when two (2) employees are working on a residential second floor, without the use of any type of fall protection systems and are exposed to 12-foot five-inches fall hazard.  Jara Construction Inc. was previously cited for a Willful-Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1608786, citation number 1, item number 1 and was affirmed as a final order on 09/21/2022, with respect to a workplace located at 2728 Cranbrooke Ln., Lot 2726, Delaware, Ohio 43015.  Jara Construction Inc. was previously cited for a Willful-Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1518040, citation number 1, item number 2 and was affirmed as a final order on 8/13/2021, with respect to a workplace located at 11121 Cedar Crest Drive, Plain City, Ohio 43064.  Jara Construction Inc. was previously cited for a Willful-Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1519871, citation number 1, item number 2 and was affirmed as a final order on 5/26/2021, with respect to a workplace located at 282 Riverside Dr., Commercial Point, Ohio 43116.  Jara Construction Inc. was previously cited for a Willful-Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1512315, citation number 2, item number 1 and was affirmed as a final order on 3/15/2021, with respect to a workplace located at 766 Fescue Road, Sunbury, Ohio 43704. 29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. The employer does not provide a training program for each employee who might be exposed to fall hazards.   The most recently occurred on or about August 25, 2022, on the job site located at 621 Peck Lane Lot 72, New Albany, OH 43054.
