29 CFR 1910.176(a):Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about September 21, 2022, the employer did not adequately mark aisleways to separate pedestrian workers from forklift traffic in areas such as but not limited to the Grinds room in that a pedestrian employee was hit by a forklift (Model: J35XNT Serial #: K160N07782S) while working.

29 CFR 1910.178(n)(6): Traveling. The driver shall be required to look in the direction of, and keep a clear view of the path of travel. a) On or about September 21, 2022, the employer did not ensure that forklift operators were looking in the direction of travel in that in the Grinds room a forklift operator did not look in their direction of travel and struck an employee from behind.
