29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a) On January 20, 2023 the employer did not provide one or more methods of machine guarding to protect the employees from ingoing nip points and rotating parts, in that the Line-180 Omori Tray Wrapper STN-8500WE hold down conveyor did not have a guard installed.  b) On January 20, 2023 the employer did not provide one or more methods of machine guarding to protect the employees from ingoing nip points and rotating parts, in that the Line-190 Omori Tray Wrapper STN-8500WE hold down conveyor did not have a guard installed.  c) On January 20, 2023 the employer did not provide one or more methods of machine guarding to protect the employees from ingoing nip points and rotating parts, in that the Line-250 Omori Tray Wrapper STN-8500WE hold down conveyor did not have a guard installed.

29 CFR  1910.212(a)(3)(ii): Point of operation guarding. The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  a) On or before January 20, 2023 the employer did not ensure the point of operation was guarded in that in the Beef Department Line-220 Biro Bandsaw guards were not lowered to guard the 3" unused portion of the blade.  b) On or before January 20, 2023 the employer did not ensure the point of operation was guarded in that in the Beef Department Line-190 Biro Bandsaw guards were not lowered to guard the 2" unused portion of the blade.  c) On or before January 20, 2023 the employer did not ensure the point of operation was guarded in that in the Beef Department Line-180 Biro Bandsaw guards were not lowered to guard the 2" unused portion of the blade.

29 CFR  1910.212(a)(3)(iii):Special handtools for placing and removing material shall be such as to permit easy handling of material without the operator placing a hand in the danger zone. Such tools shall not be in lieu of other guarding required by this section, but can only be used to supplement protection provided.  a) On or about October 18, 2022 the employer did not ensure special handtools were used to permit easy handling of meat without the operator placing a hand in the danger zone while using the Beef Department line-220 Biro bandsaw.  Empire Packing Company, LP was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(3)(iii), which was contained in OSHA inspection number 1434792, citation number 1, item number 1 and was affirmed as a final order on February 3, 2020, with respect to a workplace located at 4780 Alliance Dr. Mason, OH 45040.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a) On or about January 20, 2023 the employer did not report an employee's amputation to OSHA within twenty-four hours. The employee amputation occurred on October 18, 2022, and was reported to OSHA on January 12, 2023.
