29 CFR 1910.134(c)(2)(ii):In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks). a) On October 12, 2022, the employer did not establish and implement the elements of a respiratory protection program that are necessary for voluntary use by employees in that employees were not medically evaluated prior to using the respirators.

(Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.) a) On or about October 12, 2022, the employer did not maintain copies of the required safety data sheets for the hazardous chemicals such as but not limited to Sherwood Kem Aqua Clear Gloss (skin and eye irritant) and Sayer Lacker (skin and eye irritant) that was stored and used inside their establishment.

29 CFR 1910.1200(h)(1):Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. a) On or about October 12, 2022, the employer did not provide training to employees on the hazardous chemicals used and stored in their work areas such as but not limited to Sherwood Kem Aqua (skin and eye irritant) and Sayer Lacker top coat (skin and eye irritant).

Each employer required by this Part to keep records of fatalities, injuries, and illnesses must record each fatality, injury and illness that: is work-related; and is a new case; and meets one or more of the general recording criteria of �1904.7 or the application to specific cases of ��1904.8 through 1904.12. On or about October 12, 2022, the employer did not record the following workplace injuries on the OSHA 300 log for calendar year 2022 in that 5 injuries had not been recorded: a) On or about July 11, 2022, one recordable injury occurred which resulted in 3 days away from work was not recorded on the log until 10/12/22. b) On or about August 3, 2022, one recordable injury occurred and was not recorded on the log until 10/12/2022. c) On or about September 27, 2022, one recordable injury occurred which resulted in 3 days away from work and 5 days of on the job restrictions and was not recorded on the log until 10/12/22.

The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer. a) On or about October 12, 2022, the employer did not provide appendix D to employees wearing respirators voluntarily.
