29 CFR 1910.176(a):Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about October 12, 2022, the employer did not ensure that permanent aisles and passageways were maintained as appropriately marked on the warehouse floor in order for employees to correctly identify traffic areas designated for walking and powered industrial vehicle traffic.

29 CFR 1910.178(l)(1)(ii):Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) On or before October 12, 2022, the employer did not ensure that employees successfully participated in and completed a forklift training program prior to being allowed to operate a Mitsubishi model FG25N forklift or a Big Joe powered walk behind forklift.
