29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  On or about April 21, 2023, the employer failed to submit documentation and certification of corrective action for citation 1, item 1 issued on January 12, 2023 with the abatement due date of February 1, 2023.  On or about April 21, 2023, the employer failed to submit documentation and certification of corrective action for citation 1, item 2 issued on January 12, 2023 with the abatement due date of February 1, 2023.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  On or about October 12, 2022, employees engaged in residential construction activities were exposed to fall hazards while working from heights above 6 feet without fall protection.  BCR Construction Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1574656, citation number 1, item number 2 and was affirmed as a final order on March 19, 2022, with respect to a workplace located at 10608 Hidden Arch Dr. El Paso, TX 79924.  BCR Construction Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1513188, citation number 1, item number 1 and was affirmed as a final order on August 16, 2021, with respect to a workplace located at 6621 La Puesta Dr. El Paso, TX 79928.  BCR Construction Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1329999, citation number 2, item number 2 and was affirmed as a final order on October 26, 2018, with respect to a workplace located at 987 Grande Vole, El Paso, TX 79932.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.      Construction site: On or about October 12, 2022, the employer did not ensure that employees working on a two-story residential property roof retained the requisite understanding or skill for safe work practice. This condition exposed employees to fall hazards greater than 6-feet to the ground below.  BCR Construction Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1574688, citation number 2, item number 1 and was affirmed as a final order on April 14, 2022, with respect to a workplace located at 1233 Desert Path Dr. El Paso, TX 79928.
