29 CFR 1926.102(a)(1):  The employer did not ensure that each affected employee was using appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a)  On October 19, 2022,  Employees were exposed to eye injury while using pneumatic nail guns without eye protection during framing work.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:       a) On or about October 19, 2022, employees were exposed to the hazard of falling where a portable extension ladder did not extend at least 3 feet above the intended landing surface of the upper deck.    No abatement certification or documentation required for this violation.

29 CFR 1926.501(b)(1):   The employer did not ensure that each employee engaged in framing activities on a flat structure with unprotected sides and edges (6) feet or more above lower levels, was protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.    a)  On October 19, 2022,  employees performing carpentry and framing operations were not protected from falling from the building, thereby exposing employees to falls of approximately thirty (30) feet, on the 2nd story of the structure.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
