29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. Cup Making Department: On or about October 14, 2022 the guards on the Cup Making Machine #2, in Line #9, were not affixed to the machine to protect employees from moving parts and thermal energy, during normal operations. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. Cup Making Department: On or about October 14, 2022, the employer did not ensure that employee(s) were trained to isolate energy sources on Cup Making Machine #2, prior to servicing and/or maintenance activities. Employee(s) were exposed to burn injuries while accessing the hazardous areas of the machine to perform work such as cleaning and cup removal from Cup Making Machine #2, Line #9. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) are not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (1) prepare for shutdown, (2) shut down machine or equipment, (3) physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the energy source, (4) affix lockout or tagout devices to each energy isolating device by authorized employee, (5) relieve, disconnect, restrain or otherwise render safe all stored or residual energy, (6) verify that isolation and deenergization of the machine or equipment have been accomplished: Cup Making Department: On or about October 14, 2022 employee was exposed to machine hazards from moving parts and burns when employee was engaged in servicing and maintenance activities on the Cup Making Machine #2, Line #9. The employer does not ensure that energy control application steps are implemented prior to allowing employees to clean, or remove accumulated cup residue. The machine is not shut down or turned off prior to engaging in these activities, exposing employees to thermal hazards that could result in severe burns. The employee was not protected from the hazardous energy of machinery or equipment and suffered third degree burns to the right hand. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
