1926.1060(b): The employer did not provide retraining as necessary for each employee using ladders and stairways so that the employee maintained the understanding and knowledge acquired through prior training: a. The Roof - On or about October 28, 2022, employees were accessing the roof by means of extension ladders for the purpose of installing shingles on a multilevel single-family house without the use of fall protection. The ladders were not extended 3 feet above the landing and employees were exposed to fall hazards in excess of 10 feet. No abatement certification required.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a. The Roof - On or about October 28, 2022, employees were installing shingles on a multilevel single-family house without the use of fall protection, employees were exposed to fall hazards in excess of 10 feet. R&L Siding, LLC. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1266769, citation number 2, item number 1 and was affirmed as a final order on 12/01/2017, with respect to a workplace located at 870 Stonebridge Drive, Lancaster, PA 17601. No abatement certification or documentation required.
