OSH ACT of 1970 Section (5)(a)(1)  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a)  2482-2492 Artesian Way Neffsville PA, Jobsite Roof - On or about November 3, 2023, Employees worked from an elevated platform with the end rails down while attached to a Genie GTH-844 telehandler boom exposing employees to fall hazards up to approximately 20 feet.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  a)  2482-2492 Artesian Way Neffsville PA, Jobsite Roof - On or about November 3, 2023, employees were observed working from an elevated platform supported on the forks of a Genie GTH-844 telehandler. The operator had dismounted the cab leaving the forks elevated and no one at the controls exposing the employees to an approximate 20-foot fall hazard to the ground below.  b) 2482-2492 Artesian Way Neffsville PA, Jobsite Roof - On or about November 3, 2023, the employer allowed employees to operate a Genie GTH-844 telehandler with a severely damaged tire.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

1926.503(c)(3)  Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill: 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  2482-2492 Artesian Way Neffsville PA, Jobsite Roof - On or about November 3, 2023, Employees performed residential roofing activities on a steep residential roof donned a body harness as part of a personal fall arrest system but did not attach to an anchor point and were exposed to fall hazards up to approximately 20 feet.  Corrected during the inspection, no abatement certification or documentation required.
