29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  Manuel Garcia dba Manuel Garcia, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   (a) Citation 1, Item 1; a serious violation of 29 CFR 1926.501(b)(13) with an abatement date of March 8, 2023.  (b) Citation 1, Item 2; a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of March 21, 2023.  (c) Citation 1, Item 3; a serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of March 8, 2023.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   (a) On or about October 28, 2022, employees conducting roofing activities (shingle installation) on a third story 4:12 pitch roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 27 feet on the north and south sides of the structure.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about October 28, 2022, employee(s) conducting roofing work while standing on the roof of the structure had not been trained to recognize the associated hazards and how to minimize or eliminate those hazards. This exposed employees to a fall of approximately 27 feet onto concrete and asphalt.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about, October 28, 2022, the portable extension ladder being used to access the upper landing area, or roof of the structure did not extend at least three feet above the upper landing area. This exposed employees accessing and egressing the roof to a fall hazard of approximately 27 feet.
