On or about November 1, 2022 at the address of 20585 Bristol Dr. Lakeside Marblehead OH, 43440: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.

On or about November 1, 2022 at the address of 20585 Bristol Dr. Lakeside Marblehead OH, 43440: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing roofing operations from elevated surfaces greater than six feet from the level below.

29 CFR  1926.102(a)(1): The employer does not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a)	The employer David Troyer Construction LTD does not protect each employee from eye/face injuries caused by flying debris while performing roofing activities atop a two-story residential structure by ensuring the use of eye/face protection when operating pneumatic fasteners. This most recently occurred on November 1, 2022, during the installation of a new residential roof at location 20585 Bristol Dr. Lakeside Marblehead OH, 43440.   David Troyer Construction LTD was previously cited for a violation of this Occupational Safety and Health Standard 1926.102(a)(1), which was contained in OSHA inspection number 1549704, citation number 1, item number 2 and was affirmed as a final order on November 1, 2021, with respect to a workplace located at 151 Dunway Ave. North Caton, OH 44720.  David Troyer Construction LTD was previously cited for a violation of this Occupational Safety and Health Standard 1926.102(a)(1), which was contained in OSHA inspection number 1456535, citation number 1, item number 1 and was affirmed as a final order on October 10, 2020, with respect to a workplace located at 7670 Strausser St. NW North Canton, OH 44720.  David Troyer Construction LTD was previously cited for a violation of this Occupational Safety and Health Standard 1926.102(a)(1), which was contained in OSHA inspection number 1336512, citation number 1, item number 1 and was affirmed as a final order on October 16, 2018, with respect to a workplace located at 1255 Longshadow Ave. North Canton, OH 44720.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)	The employer David Troyer Construction LTD does not protect each employee from fall hazards while performing roofing activities by the used of guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on November 1, 2022, during the installation of a new residential roof at location 20585 Bristol Dr. Lakeside Marblehead OH, 43440. Employees were exposed to the hazard of falling approximately 11ft - 22 ft to the ground below with the use of personal fall protection system or an alternative fall protection method.   David Troyer Construction LTD was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1549704, citation number 1, item number 3 and was affirmed as a final order on November 1, 2021, with respect to a workplace located at 151 Dunway Ave North Canton, OH 44720.
