29 CFR  1926.21(b)(1):The employer did not initiate or maintain an accident prevention program(s) as may be necessary to comply with this part:  On or about May 01, 2025, the employer did not initiate and maintain safety and health programs/safety enforcement related to hazards and unsafe conditions while building, erecting, and bracing an exterior wall on the first floor of a new multi-unit construction site located at 840 White Pond Drive, Akron, OH 44313. Employees were performing work on exterior walls using pneumatic nail guns without eye protection, head protection/hard hats, and exposed to struck by/crushing hazards that included an exterior wall which collapsed inward and fatally injured an employee.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about May 01, 2025, the employer did not instruct employees in the recognition of hazards and unsafe conditions while building, erecting, and bracing an exterior wall on the first floor of a new multi-unit construction site located at 840 White Pond Drive, Akron, OH 44313. The lack of employer instruction led to the deficient bracing of the exterior wall which collapsed inward and fatally injured an employee.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:   The employer does not protect each employee from eye injury caused by flying debris while performing framing activities (installing material with air driven tools) on structures by ensuring the use of eye protection while engaging in work activities. This most recently occurred during the framing material at jobsite located at 840 White Pond Drive, Akron, OH 44313: the employer did not ensure employees engaged in building, erecting, and bracing an exterior walls on the first floor of a new multi unit construction using pneumatic nails guns were protected from struck by hazards by wearing eye or face protection.

David Troyer Construction, LTD. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 1549704, citation number 1, item number 1 and was affirmed as a final order on 11/01/2021, with respect to a workplace located at 151 Dunway Ave NE Canton, OH 44720.    David Troyer Construction, LTD. was previously cited for a violation of this occupational safety and health standard or its equivalent, 1926.100(a) which was contained in OSHA inspection number 1336512, citation number 2, item number 1 and was affirmed as a final order on 10/16/2018, with respect to a workplace located at 1255 Longshadow Ave North Canton, OH 44720.    David Troyer Construction, LTD. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 1148509 citation number 1 item number 1 and was affirmed as a final order on 6/27/2016, with respect to a workplace located at 779 White Pond Akron, Ohio 44320.
