29 CFR  1910.30(a)(1): Fall hazards.  Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart.  Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.  A) On or about November 1, 2022, the employer did not ensure that the training for fall hazards was adequate in that the fall hazard height  of four feet was not recognized in all training documents provided, nor was the use of six foot shock absorbing lanyards explained to order picker operators working at heights of approximately 4 to 10 feet were not protected by the use of the 6 foot shock absorbing lanyards in the event of a fall.

29 CFR  1910.178(l)(3)(i)(M): Any other operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate.  a) On or about November 1, 2022, the employer did not ensure that employees were adequately trained according to the operator manual,  when two employees were operating the Crown order picker, employees were not instructed about attaching to different anchor points versus the same anchor points on the Crown order pickers.

29 CFR  1910.140(c)(6):(6) A competent person or qualified person must inspect each knot in a lanyard or vertical lifeline to ensure that it meets the requirements of paragraphs (c)(4) and (c)(5) before any employee uses the lanyard or lifeline.  A) On or about November 1, 2022, the employer did not ensure that a competent person was inspecting the self-retracting lanyard, shock-absorbing lanyard, and the harness prior to each use.

29 CFR  1910.140(c)(13): Anchorages, except window cleaners' belt anchors covered by paragraph (e) of this section, must be: (i) Capable of supporting at least 5,000 pounds (22.2 kN) for each employee attached; or  (ii)  Designed, installed, and used, under the supervision of qualified person, as part of a complete personal fall protection system that maintains a safety factor of at least two.  A) On or about November 1, 2022, the employer did not ensure that the anchor points used by employees were engineered to withstand the fall of at least 5,000 pounds each when two employees were tied off at the same anchor point location.  The Morris Furniture Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.140(c)(13)(i), which was contained in OSHA inspection number 1420883, citation number 1, item number 1, and was affirmed as a final order on 10/03/2019, with respect to a workplace located at Morris Furniture Co., Inc. 2377 Commerce Center Blvd, Fairborn, OH 45324.

29 CFR  1910.140(c)(12): Anchorages used to attach to personal fall protection equipment must be independent of any anchorage used to suspend employees or platforms on which employees work.  Anchorages used to attach to personal fall protection equipment on mobile work platforms on powered industrial trucks must be attached to an overhead member of the platform, at a point located above and near the center of the platform.  A) On or about November 1, 2022, the employer did not ensure that the anchor points on the Crown order pickers  SP Series: serial 10331907, Crown Order Picker SP Series: serial 10331908, and  Crown Order Picker SP Series: serial 10331909 were independent to suspend employees or platforms on which the employees worked.  Two employees were working off of the same anchor point, the bar across the work rest.
