29 CFR 1910.29(b)(2)(i): The employer did not ensure that guardrails met the requirement that mid rails are installed at a height midway between the top edge of the guardrail system and the walking-working surface. Employees engaged in grain operations at 28115 158th Street, Duncan, Nebraska 68634, were exposed to fall hazards on the southwest upper platform in the loadout area. There was not a mid rail installed between the top rail and the toe board on the backside of the upper platform.

29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). Employees engaged in grain operations at 28115 158th Street, Duncan, Nebraska 68634, were exposed to struck by hazards in that an Nissan 30 forklift was not equipped with rear lights as required by the employer pre-inspection checklist and the operators manual for the forklift.
