29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): Employees were exposed to walking-working surface hazards in that the metal floor plate covering access to the boot pit area shifted and caused employee to fall approximately 22 feet from the main floor landing to the boot floor below.

29 CFR 1910.272(k):Receiving pit feed openings in the grain handling facility, such as truck or railcar receiving pits, were not covered by grates which had a maximum opening width of 2.5 inches: Employees were exposed to explosive hazards in that the receiving pit grate was measured at 3.5 inches which could allow fugitive metal products to infiltrate the leg.
