29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: On or about November 22, 2022, employees working in an excavation approximately 12 feet deep were exposed to cave-in hazards and the employer had not ensured a competent person inspected the sloping and benching configurations.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): On or about November 22, 2022, employees working in an excavation approximately 12 feet deep were exposed to cave-in hazards and the employer had not ensured the sloping and benching configurations were one and one-half horizontal to one vertical or more.
