1926.21(b)(1) The employer should avail himself of the safety and health training programs the Secretary provides. On or about November 29, 2022, the employer failed to avail an employee of the Secretary of Labor's health and safety training programs, exposing the employee to struck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On or about November 29, 2022, an employee was not protected from a fall while engaged in residential construction activities, exposing the employee to a fall of 10 feet. Donovan Construction, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.0501(b)(13), which was contained in OSHA inspection number 1620948.015, citation number 1, item number 2 and was affirmed as a final order on December 8, 2022, with respect to a workplace located at 17029-17035 Foxtail Dr. Orland Park, IL 60467. Donovan Construction, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.0501(b)(13), which was contained in OSHA inspection number 1521393.015, citation number 1, item number 2 and was affirmed as a final order on June 10, 2021, with respect to a workplace located at 317 7th Avenue La Grange, IL 60525. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
