29 CFR  1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  On or about November 29, 2022,  Scaffolds were not erected, moved, dismantled, and/or altered under the supervision and direction of a competent person as required and/or such activities were not performed by experienced and trained employees selected for such work by the competent person. Employees were exposed to fall in excess of 10 feet due to scaffold not fully planked and missing  guard rails.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:   On or about November 29, 2022, Employees performing masonry work at a residential property were exposed to fall hazards in excess of 15 feet with no proper fall protection when the employer did not ensure they were adequately trained to recognize and minimize the hazards associated with fall.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   On or about November 29, 2022, Employees were exposed to fall hazards in excess of 15 feet while engaged in residential masonry activities on the roof. Fall protection was not being utilized while the employee was performing masonry activities standing on the roof.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports.    On or about November 29, 2022, the employer did not ensure that scaffolds were fully planked. Employees engaged in masonry installations from a metal framed scaffold were not provided with a fully planked working level, exposing employees to falls in excess of 15 feet.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).  Universal Masonry Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.451(b)(1), which was contained in OSHA inspection number 1453999, citation number 2  item number 1 and was affirmed as a final order on March 9, 2020, with respect to a workplace located at 28 Sheffield, Oak Brook, IL 60521.

No fall protection was being utilized.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).  Universal Masonry Construction, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard  1926.451(g)(1), which was contained in OSHA inspection number 1453999, citation number 2, item number 2 and was affirmed as a final order on March 9, 2020, with respect to a workplace located at 28 Sheffield Ln. Oakbrook, IL 60521.  Universal Masonry Construction, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard  1926.451(g)(1), which was contained in OSHA inspection number 1346301, citation number 1, item number 1 and was affirmed as a final order on February 6, 2019, with respect to a workplace located at 605 Jefferson St. Naperville, IL 60540.
