On or about December 8, 2022, and times prior, the employee was observed leaving the forklift unattended while he was loading a customers order. The employer was also present and in plain site of the employee leaving the PIT unattended.

29 CFR 1910.178(n)(8):Under all travel conditions the truck shall be operated at a speed that will permit it to be brought to a stop in a safe manner. a). On or about December 8, 2022, and times prior, and employee was observed by CSHO driving erratic and at a high rate of speed going in and out of the plant. The employer was present and in the smoking area, in plain sight of the forklift operation at the time and failed to address the employee.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a). FCA, LLC, On or about December 8, 2022, and at times prior, employees were exposed to physical hazards, in that the employer failed to ensure employees wear seatbelts when operating powered industrial trucks. Upon arrival to worksite for and inspection, CSHO observed an employee operating a powered industrial truck without a seatbelt while loading a flatbed truck with material.

29 CFR 1910.157(e)(2): Portable extinguishers or hose used in lieu thereof under paragraph (d)(3) of this section shall be visually inspected monthly. a). On or about December 8, 2022, and times prior, the employer did not perform a monthly inspection or test of all portable fire extinguishers at the workplace. Fire extinguishers located on the production floor had not received its monthly inspection. The last monthly inspection check recorded on the service tag was on April 2022 on one of the extinguishers and March 2022 on another extinguisher in the area of inspection.
