29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   (a) On or about December 12, 2022, a competent person was on site but did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected.  Swift Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(2) , which was contained in OSHA inspection number 1436925, citation number 1, item number 1 and was affirmed as a final order on April 2, 2020, with respect to a workplace located at 5410 W. Wells Street, Milwaukee, WI 53214.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about December 12, 2022, employees operating circular saws and using pneumatic nail guns without eye or face protection while installing roof sheathing and performing roof tear off, were exposed to struck by hazards that cause puncture wounds and potential blindness or eye injury.  Swift Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1) , which was contained in OSHA inspection number 1436925, citation number 1, item number 2 and was affirmed as a final order on April 2, 2020, with respect to a workplace located at 5410 W. Wells Street, Milwaukee, WI 53214.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.    (a) On or about December 12, 2022, employees conducting roofing work on an existing roof with a 4:12 pitch, were not wearing fall protection. This exposed employees to a fall hazard of approximately 13 feet from the Church roof.  Swift Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) , which was contained in OSHA inspection number 1577606, citation number 1, item number 1 and was affirmed as a final order on August 4, 2022, with respect to a workplace located at 3360 S. Kinnickinnic Ave, Milwaukee, WI 53207.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  (a) On or about December 12, 2022, an aluminum Werner extension ladder erected on the north side of the Structure and being used for access to the roof, was not taken out of service, and/or tagged and marked do not use, when ladder was unserviceable and/or defective. This exposed employees to a fall hazard in-that the ladder had broken/damaged rungs.  Swift Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(16) , which was contained in OSHA inspection number 1436925, citation number 1, item number 6 and was affirmed as a final order on April 2, 2020, with respect to a workplace located at 5410 W. Wells Street, Milwaukee, WI 53214.
