29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  Maestro Construction, Inc. at the worksite located at 1310-1314 Greenbrook Ct. Hanover Park, Illinois:    On December 12, 2022, employees installing truss spacers and nailing truss heals to wall top plates were exposed to struck-by hazards when working on and between trusses that had not been braced to resist out-of-plane buckling, leaning, and/or collapse due to the lack of top cord, web member, bottom chord and diagonal bracing.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On or about December 12, 2022, employees were not trained to recognize and minimize falls at a residential construction site, exposing employees to a falls between 10 and 20 feet.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d)

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about December 12, 2022, employees were not protected by hard hats when working around suspended crane loads, exposing employees to struck-by hazards.  Maestro Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a) which was contained in OSHA inspection number 1601233, citation number 1, item number 1 and was affirmed as a final order on September 1, 2022, with respect to a workplace located at 3644 White Eagle Dr. Naperville, IL 60564.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d)

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about December 12, 2022, employees were not protected from a fall while setting wood truss at a residential construction site, exposing employees to a falls between 10 and 20 feet.   Maestro Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1601233, citation number 1, item number 2 and was affirmed as a final order on September 1, 2022, with respect to a workplace located at 3644 White Eagle Dr. Naperville, IL 60564.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d)
