OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing or struck by hazards created by hoist malfunction or failures: On or about January 10, 2023 and prior, at an establishment located at 313 Appleton Street, in Menasha, Wisconsin; the employer had not developed a periodic and frequent inspection for the Harrington 1/4 Ton hoists and Harrington 1 Ton hoist while used to lift parts onto and off a conveyor line exposing employees to potential crushing or struck by hazards.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On or about January 10, 2023 and prior, at an establishment located at 313 Appleton Street, in Menasha, Wisconsin; the employer did not obtain written approval from the manufacturer prior to attaching and utilizing Ballymore personnel platform for employees to change out hoists from the line.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about January 10, 2023 and prior, at an establishment located at 313 Appleton Street, in Menasha, Wisconsin; the employer had not ensured that the forklifts were inspected daily to ensure they were in safe operating condition prior to placing them in service.
