29 CFR  1926.651(k)(2):Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  On or about January 19, 2023, the competent person failed to remove an employee from the hazards associated with working in and around an unprotected trench at a depth of 5.7 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about January 19, 2023, an employee was not protected by a hard hat while working in a trench at a depth of 5.7 feet, exposing employees to struck-by hazards.  Mauro Sewer Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 1323884, citation number 1 item number 1 and was affirmed as a final order on December 19, 2018, with respect to a workplace located at 2266 Cedar St. Des Plaines, IL 60016.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  On or about January 19, 2023, an employee was not protected by a protective system while working in a trench at a depth of 5.7 feet, exposing employees to the hazards associated with a cave-in.  Mauro Sewer Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1500388 , citation number 2 item number 1 and was affirmed as a final order on March 29, 2021, with respect to a workplace located at Cherry St. And Wisner St. Park Ridge, IL 60068.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about January 19, 2023, an employee used a ladder that did not extend three feet past the upper landing of a trench, exposing the employee to  a fall.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
