29 CFR 1910.1026(d)(2)(iii): The employer used the scheduled monitoring option, and monitoring revealed employee exposures to chromium (VI) to be at or above the action level; however, the employer did not perform periodic monitoring at least every six months: On or about April 6, 2023, an employee in the maintenance department was exposed to an 8-hour time weighted average (TWA) of 4.4 �g/m3 for chromium (VI). The exposure level was derived from a sample collected over an 8 minutes sampling period with zero exposure assumed for the unsampled period of 472 minutes. The employer failed to perform period monitoring at least every six months when employees exposures to chromium (VI) are at above the action level.

29 CFR 1910.1026(d)(2)(vi): The employer did not perform additional monitoring when there had been a change in the production process, raw materials, equipment, personnel, work practices, or control methods that resulted or may have resulted in new or additional exposures to chromium (VI), or when the employer had any reason to believe that new or additional exposures had occurred: On or about April 6, 2023, an employee in the maintenance department was exposed to an 8-hour time weighted average (TWA) of 4.4 �g/m3 for chromium (VI). The exposure level was derived from a sample collected over an 8 minute sampling period with zero exposure assumed for the unsampled period of 472 minutes. The employer failed to perform additional monitoring when there had been a change in the workplace condition that resulted in new or additional exposures to chromium (VI). Monitoring was not performed after the introduction of the Miller Spectrum DC Plasma Cutting System 375 X-TREME in the maintenance department.

The exposure level was derived from a sample collected over an 8 minutes sampling period with zero exposure assumed for the unsampled period of 472 minutes. The employer failed to make medical surveillance available for all employees who could be occupationally exposed to chromium (VI) at or above the action level for 30 or more days a year. Employees are exposed to chromium (VI) during welding and plasma cutting activities.
